Scotland has made Environmental Impact Assessments mandatory for all new data centres with power capacity above 50 megawatts, under a planning direction that took effect on 17 September.

The instrument requires an assessment to be submitted during planning where a development exceeds the capacity threshold and falls within the industrial estate or urban development descriptions specified in the direction. Both conditions must be satisfied. Proposals below 50MW remain subject to case-by-case screening under Scotland's existing 2017 environmental impact regulations, and ministers retain powers to direct that a particular project requires assessment even where ordinary thresholds are not met.

It follows a separate direction in force since 17 August requiring planning authorities to notify Scottish Ministers of any data centre application above 50MW within seven days of validation. The new direction was developed with input from the Scottish Science Advisory Council.

Public finance minister Hannah Mary Goodlad said the sector was rapidly evolving and attracting a broad range of views, and that evidence on environmental impact continues to develop. She said an emerging industry presented an opportunity to get the approach right from the start, and that requiring assessment in every application would create a level playing field for developers while ensuring significant effects were considered from the outset. She framed it as balancing economic and employment interests against national energy, climate and community wealth building ambitions.

The announcement came hours before a Holyrood debate on a Scottish Greens motion calling for a moratorium on planning applications for new hyperscale data centres until a national strategy and updated guidance are produced.

Campaigners welcomed the direction while calling it insufficient. Kim Pratt of Friends of the Earth Scotland said assessments were necessary but did not on their own make a project more environmentally friendly. Dr Kat Jones of Action to Protect Rural Scotland said the first four applications currently under consideration would together use as much energy as Torness nuclear power station, which is due to close in 2030.

The direction changes the sequence rather than the answer, and that is the point of it.

Before this, a large data centre could be screened case by case, with the developer and the planning authority arguing about whether an assessment was needed at all. That argument consumed time and produced inconsistent outcomes, since one authority might screen a project in and another screen a comparable one out. Making assessment automatic above 50MW removes the preliminary dispute and moves straight to the substance.

Goodlad's phrase about a level playing field is the honest description. Mandatory assessment is not primarily a barrier. It is a standardisation, and developers generally prefer a known requirement to a discretionary one, because a known requirement can be budgeted and scheduled.

Which is why campaigners are unsatisfied. An assessment documents environmental effects. It does not prevent them, and nothing in the direction obliges a planning authority to refuse a project whose assessment is unflattering. Friends of the Earth Scotland made exactly that point, and Action to Protect Rural Scotland noted that planning decisions are due within weeks while the government has proposed acting by year end.

The gap between those two timelines is the real dispute. A procedural requirement that applies from today does nothing about applications already in the system, and the campaign is about those rather than about future ones.

The energy comparison is the number that will travel, and it deserves scrutiny in both directions.

Four applications consuming as much electricity as Torness, a station that has supplied Scotland for four decades and closes in 2030, is a genuinely startling framing. It is also a comparison of demand against a single plant rather than against national generation, and data centres draw continuously rather than at peak, which makes them easier to supply than an equivalent residential load.

What it does capture accurately is that this is a grid question rather than a planning one. A 50MW threshold is low by the standards of the current buildout, where campuses are discussed in gigawatts, and the first four Scottish proposals alone are large enough to matter to national supply. Assessing each application separately will not answer whether the country has the generation for all of them together, which is precisely what the moratorium campaign is asking.

The risk factor language is worth connecting. SB Energy, the SoftBank-controlled developer, warned in its US IPO filing this month about community opposition, local moratoria and growing public resistance to AI infrastructure. Anthropic's coming prospectus is expected to carry a comparable warning. Scotland is that risk factor becoming an operative planning instrument.

For India the relevance is direct and largely unexamined. Investments and commitments into Indian data centres and allied sectors reached $33.3 billion in the first half of this year. Infrastructure was the single largest sector for Indian private equity and venture investment in July. None of that capital has yet encountered a Scottish-style constraint, and Indian environmental clearance for industrial projects has generally not been the binding limitation.

Whether that holds is a question of when, not whether. Every jurisdiction running this buildout eventually confronts the same arithmetic, and the water and power demands of a gigawatt campus do not change with the postcode.
